EEOC Continues to Investigate Nike’s DEI Policies

The U.S. Equal Employment Opportunity Commission (EEOC) has recently asked a federal court to enforce a subpoena against Nike regarding an ongoing investigation into the organization’s workplace practices.

Specifically, the investigation is examining whether Nike has discriminated against its white employees as a result of the company’s Diversity, Equity, and Inclusion (DEI) policies.

The EEOC’s discrimination claims against Nike are not brand new, but we are now seeing the government agency ramp up pressure as it attempts to force subpoenas, as the EEOC argues that Nike has not produced all responsive information.

Fitting in with President Trump’s anti-DEI efforts, the May 2024 Charge of Discrimination alleged that Nike engaged in “a pattern or practice of disparate treatment against White employees,” relating to training programs, hiring and firing decisions, and intership and mentorship opportunities.
